in a deadly crime spree in san jose. 26-year-old jonathan wilbanks was caught friday night after a series of robberies, police chase and shooting and a carjacking attempt that left one man dead. >> about 9:00 i hear a -- not continuous gunshots but maybe a little one after another. >> saw the victim's father up in the front and she was still in shock finding out that the son had been shot in front of the 7-eleven. >> police say wilbanks' alleged accomplice got away and is still on the run. the reward money is being offered for information that leads to his arrest. >>> menlo park police are looking for suspects in the city's second murder this year. 42-year-old man shot to death saturday night as he sat in a car with a woman in the 300 block of ivy drive. police say the suspects took the woman's purse and ran in separate directions. it's the third shooting this month in menlo park's bell haven neighborhood. >>> a new apology from the bishop of san jose. that's after a registered sex offender was allowed to volunteer at a school festival and now the church and the sheriff's office are tryin

into san jose this morning. been watching this cell making its way further southward. a few minutes ago in milpitas, now into san jose and alum rock. looks like it's what we'll expect to see throughout the day today as we seal scattered showers, then sunshine, a more scattered showers possible. we may get the back side of this system you can see one little wave of energy moving through here. that drags through overnight bringing thunderstorms. behind that we dry out. but there's more to the north and that's the going to slide in our direction in the latter part of the day and overnight tonight. temperatures chilly outside right now. only 30s in toward the santa rosa area. you have 40s elsewhere. by the afternoon these numbers staying well below the average. it will be a chilly day usually we are in the 60s and 70s, today wow it's going to be cold only highs in the 50s, elizabeth. bundle up. >> i know. yeah. pack your chains if you are heading up to the sierra and be extra careful on the roads. it's slick everywhere include at the bay bridge toll plaza. delays now at least in those outer

.com/weather. >>> a fire ripped through a south bay camper today. cbs 5 reporter elissa harrington is in san jose with the good man is who saved the women inside. >> reporter: frightening moments for the two women inside this camper when it caught on fire. but thanks to that good samaritan, they made tout alive. here's some video taken by a cbs 5 viewer who saw this happen. this camper is parked on santiago avenue near tully road. now here's some video of the good samaritan. he is an employee with the evergreen school district who didn't want to be interviewed. he was driving through the area making rounds because there is a school across the street and he saw flames and heard screaming. that man got out of his car, broke the windows to the camper and forced open the door. he also tried to extinguish the flames himself using a garden hose. two women inside got out safely although one did suffer burns to her hands. the other smoke inhalation. they had been lighting candles to stay warm when they fell asleep. >> it's just one of those things during the holidays and around cold time that we burn can
. a small memorial is there for the san jose rest denied 22- year-old rory park petty ford. police have one person this custody. here's his picture. 26-year-old jonathan wilbanks was arrested on friday night. he was caught after a series of robberies, a police chase, shooting and carjacking attempt that left a man dead. here's a map that shows the path of this violent crime spree. wilbanks's alleged acome police got away but together they committed four robberies on friday at a little caesar's pizza on story road, gas station on east capital, a jack- in-the-box on curtner avenue and the spa on bird avenue. around 9:00 the pair tried to carjack 22-year-old rory in the seven eleven parking lot and shot him dead. police then spotted the car on highway 101 near interstate 280 and chased it through town. the suspects got out and opened fire on the officers. about >> about 9:00 i heard gunshots. >> saw the victim up in the front and in shock after finding out his father -- that his son had been shot in front of seven learn. >> reporter: police returned fire and hit wilbanks. one officer was treat

this morning around the bay area but it's shifted a bit further to the south into san jose staying dry for most of halloween but now they are seeing the rain falling there. you can see those showers dragging on through. nothing really heavy, just some light rain coming through and beginning to fall apart. now, as we head through the day today, this is going to sag further south and move east so heading out of town into san jose, into milpitas, you're seeing more light early on this morning. roads are slick. so be careful. behind this we have some clearing on the back side. in fact, by the afternoon, probably turning to partly cloudy skies and just a slight chance of a few showers. overlooking san francisco now, still looking good. beautiful skies orange lights and temperatures in the 50s and 60s this afternoon maybe low 70s in the warmest spots but we are thinking 80s in the not too distant future. we'll tell you when coming up. right now let's check the roads with elizabeth. >> we can barely see the dublin interchange roads. westbound 580 in the commute direction, you can see some headlights.

quentin towards san jose is asking the public for help in choosing the city's next police chief. the city is holding public hearings to talk about a replacement for chris moore who will retire at the end of january. moore has been chief for only two years. the head of the police union says his successor will have issues to deal with. >> our police department is falling apart. we have more people leaving. we had another two going to los gatos. on top of three that just went to redwood city and on top of another three or four who went to santa cruz. >> fresno police chief jerry dyer and sacramento chief rick brazil are two of the people mentioned as possible candidates. >>> other bay area headlines, two would-be robbers had a surprise when they went into a jewelry store in east san jose and started shooting. the woman behind the counter though had a gun and she fired back. no one was hit by any of the gunfire. but the two suspects ran out without any stolen jewelry. >>> a cooler. >> reporter: led to a hazardous materials incident at a gym in san jose's evergreen area. about 150 people were

showing up about 70 degrees in concord. 70 in san francisco. and 72 in san jose. this is about as good as it gets though this week. we have some rain on the horizon. we'll talk more about that in a moment. right now let's check the roads with elizabeth. >> we are going to enjoy this dry commute while we can. we are following a couple of problems though. we are seeing in the usual amount of delays right -- an unusual amount of delays right now on westbound 4 because of an accident not even blocking lanes. it's off to the shoulder approaching a street lone tree way but unfortunately it's causing heavy traffic right now through antioch. also reports of an accident westbound 580 approaching santa rita, tassajara. we can't see it but we are seeing bunching up but we have delays stop and go from the altamont pass to the dublin interchange. the nimitz 880 through oakland near the oakland coliseum, no problems. 16 minutes between 238 and the maze. and a quick note for the south bay commute in san jose, they have closed off that off-ramp from southbound 880 to the alameda for emergency roadwork
in san jose will be tried as an adult. the boy adonis muldrow will be in a courtroom this afternoon. the 15-year-old facing 8 felony counts including murder and attempted murder of a peace officer. police say he and 26-year-old jonathan wilbanks robbed a string of san jose businesses on november 16th killing this man, rory parkpettiford. an officer was also injured. >>> two men are behind bars after a violent road rage incident that was all caught on video. oakland police say the ordeal began monday when a couple noticed a car driving erratically and started shooting video with their cell phone. police say the men in that car realized they were being recorded and pulled out guns pointing them at the couple while at a stop light. a while later the men caught up with the couple again and one of them made his way inside the couple's car demanding the video. >> there husband was able to push the suspect out of the car and tells his wife hit the gas get out of here. >> police say that man fired at the couple's car. no one was hit. and with that video, officers were able to identify the s

south now through san jose so you're seeing a lot of showers in the area, pockets of some moderate amounts of rainfall and a lot of strong gusty winds to go along with that. embedded in the system are cells that are producing moderate amounts of rainfall even some heavy rainfall as you move through. some reports now already over 6, 7" of rainfall in some parts of the north bay and still more to come. you can see this band that's making its way through the bay area now and some heavier cells as we take you in for a closer look. toward mill valley heavy rainfall in the area along 101 if you are traveling along here expect heavy rainfall and the possibility of some flooding now. a lot of that water is ending up in some of the basins now so we're likely to see some flooding in the creeks and streams. flash flood watches are up for the bay area and high wind advisories. we are not done. we'll see the storm system working through the bay area so, yes, the commute is going to be very dangerous, very treacherous. watch out for debris in the roads. of course, some ponding water, as well. we

at the limit right now on 101 through san jose. here's a live sneak peek near the trimble exit. coming up a check of mass transit. >> good morning, everyone. it's thursday, november 8. i'm michelle griego. >> hi, everybody. i'm frank mallicoat. it is 5:00 on the nose now. we begin with some breaking news. a bay area hotel with no vacancy is now completely empty because of a hazmat situation. >> cbs 5's anne makovec joins us from burlingame where hundreds of guest, i would imagine, anne, they are just waiting to go back to sleep. >> reporter: they were woken up in the middle of the night by an alarm, a lot of them have spent hours in their cars here in the parking lot. i'm at the embassy suites in burlingame on anza boulevard. you can see emergency personnel still here on scene. now, this hotel has been cleared. but they are starting the process of getting people back into their rooms. they are prioritizing people with early-morning flights. the hotel is right by the airport. so several people are trying get out of town. here's how it started according to some of the officials on scene. th
and is live in san jose. how widespread is this problem? >> reporter: it's estimated there are hundreds of thousands of untested rape kits across the country waiting to be processed. but here in california, it's a different story. >> these are sealed and bind over to the police officer waiting for it. >> reporter: linda richards is a program manager for the sexual assault response team. she is also one of the nurses who performs extensive forensic exams on rape victims in santa clara county. >> it's not unusual to receive a phone call from a patient a week or so after and say you know, what did you find out about the swabs that came from my body. >> richards says the turnaround is about two months which is good considering the backlog in some states can force victims to wait years for the results. figures show in 2010 the state of illinois had processed just 20% of its rape kits. and in one county in michigan more than 11,000 rape kits were discovered untested. some dating back to the 1980s. the obstacle for many is the expense, processing one kit costs between 1200 and $3500. >> until
and you can see on doppler radar lots of yellow out there. san jose it is seeing some showers right now, some heavier rain earlier. that's soon going to be picking up. you can see north in sunnyvale that we have some stronger storms that will be sliding in your direction. so if you are heading out be careful. we have the rain and some pockets of heavy rainfall into oakland, stretching across the bay into south san francisco. a little further to the north we can see the back side of the storm system. we mentioned the possibility of flooding in petaluma. they are seeing very heavy downpours right now. expecting some flooding along the penngrove stream there. so that's expected to rise as more of that water comes down the hill so some very stormy weather there. mill valley a strong cell headed there. flash flood watches up for much of the bay area. they have been extended for the weekend. we have a lot more rain to come. we'll have more on that coming up in just a few minutes. >> if you can leave later for your morning commute, gosh, it is just a mess in a lot of spots all across the bay a
hospitals and for today only at two san jose hospitals run by hospital corporation of america. replacement nurses have been hired for five days. it will be the second nurses strike here in the bay area this month. key issues including staffing levels and sick leave are on the table. >>> egyptian president mohamed morsi says israel's aggression against gaza will end today. this is a live look right now at gaza city. it's a bit quiet right now. egypt is where talks have been going on in hopes finding a diplomatic solution to the week- long conflict between israel and hamas militants in gaza. it's now been about a week since israel began air strikes on the gaza strip. at least 113 palestinians have been reported killed in gaza. nearly half civilians. the death toll in israel is only 3. susan mcginnis has more on the continuing violence. >>> reporter: mosques in gaza issued the call for morning prayers today even as bombs and missiles rained down around them. the israeli military says it hit about 100 terror sites overnight, including the islamic national bank in gaza city that israel says it
